Today (May 12), Penny surrendered himself to authorities at the 5th Precinct in lower Manhattan, The New York Post reported. The news comes less than a day after the Manhattan District Attorney’s Office shared they were pursuing charges against Penny. “We can confirm that Daniel Penny will be arrested on a charge of manslaughter in the second degree,” a spokesperson for DA Alvin Bragg said. Before the announcement, the city’s DA’s office was under immense pressure from protesters and law officials. The public plea for charges to be filed erupted after a medical examiner ruled Neely’s death a homicide. On May 1, 30-year-old Neely boarded the NYC subway’s F train, reportedly yelling for food in a public outcry. Penny, who allegedly has training in mixed martial arts, approached the known Michael Jackson impersonator and placed him in a chokehold. According to footage of the incident, Penny held Neely in the locked position for almost 15 minutes until his body was motionless. Afterward, Neely was transported to a local hospital, where doctors pronounced him deceased. Penny was questioned by law enforcement but was not taken into custody. A few days after Neely’s passing, the former Marine released a statement regarding the 30-year-old through his legal counsel. In the release, Penny spoke about Neely having a reported history of violent behavior and untreated mental illness. He insisted his actions resulted from him protecting himself until help arrived. However, on May 8, Neely’s family slammed Penny’s claims calling his release “a character assassination.” “The truth is, he knew nothing about Jordan’s history when he intentionally wrapped his arms around Jordan’s neck and squeezed and kept squeezing,” the family noted in a letter. But in that moment, even if he was afraid to begin with, at some point, when people are screaming, "let him go, you're going to kill him," at some point, when people are saying, "he defecated on himself," which is a sign, he's losing his light. At some point, when somebody screams, "my wife is a nurse," I'm telling you, you're going to kill him. You're going to get a murder charge. He could have chose to let him go, but he didn't. Like Lennon Edwards Jordan's lawyer said when MJ made songs like Man In Mirror it was about things like this. it was about looking at ourselves and make changes in the world. sadly some people miss that message and only cared about the music not the song neither the message.

Neely's father and aunt stood silently alongside their lawyers, who said Neely had a support system, but battled "demons" and untreated mental health issues. The attorneys vowed to pursue more serious charges against Penny, who was seen on video holding Neely in a chokehold following an altercation on the subway. "Justice looks like a conviction for murder," said Lennon Edwards, Esq., an attorney with Milles & Edwards. Edwards believed Neely's family was closer to justice Friday than they were a week ago. But he's unsatisfied with Penny's manslaughter charge. "The consequences of manslaughter two is five to 15 years. Ask yourself, is that enough? Murder two, up to 25 to life. So we need a full cup of justice here," said Edwards. Family said Neely's mental health struggles started when he was 14, after the murder of his mother. "Even though he couldn't smile, he made other people smile. That's who Jordan was," said Donte Mills, an attorney with Mills & Edwards. Attorneys claim Neely was asking for food on the train and was frustrated when he encountered Penny. Police sources said Neely was acting erratically and threatening passengers. "When somebody screams, 'My wife is a nurse. I'm telling you, you're gonna kill him, you're gonna get a murder charge,' he could've chose to let him go. But he didn't. And what did he think would happen if he didn't? He had to know he would die," said Mills. Mills and Edwards said Neely's family had asked the city if he could stay longer at a mental health facility, but that he was still asked to leave because he wasn't in immediate crisis. A three-minute-long video showing Daniel Penny, a white man putting Jordan Neely, a Black man, in what was a deadly chokehold on the F train of a New York City subway car circulated around the internet in early May, and social media has been in an uproar. Some attribute the calls for justice to what finally led to charges against Penny, since he was “initially questioned by police and released without being charged.” Neely’s death was ruled a homicide by the New York City Medical Examiner “since it was the chokehold that killed him.” Although Neely’s family attorneys are supportive of the “prosecutors’ decision to charge Penny…[they] said he should have been charged with murder, not manslaughter, and that he should have been arrested sooner.” Today, the 24-year-old former Marine turned himself in, facing charges of second degree manslaughter, according to the Manhattan district attorney’s office.
