This "freedom of speech" argument sounds like a lame argument, but I'd like to see the actual court documents. I'd like the Estate to remove those attrocities from MJ's catalog and issue and public apology to MJ.

Would you want the Michael album re-issued without those tracks?
Personally I think all that's needed is a bit of a disclaimer on future pressings (these tracks have been recorded in the style of MJ based on found lyrics/demos and do not fully feature his voice) - or words to that affect.
I still think those outside the fandom don't know/care, so don't think it damages his legacy but from a personal level would be nice to know what the story is.

If they are not MJ then they should be removed from future pressings, yes. No, I don't think a disclaimer is enough. There is also no evidence that they are based on any demos or lyrics that had anything to do with MJ. And it is not that they do not fully feature his voice. His voice is only on it if it's copy and pasted from some other material (eg. ad libs from released songs), otherwise it is just not MJ. The disclaimer you suggest would still give the impression it is at least in part an MJ song which is just not true, IMO.

Shocking that they are using "freedom of speech" as their argument in this. Can that really have any legal merit?

This should definitely be getting covered more in the media.

It wouldn't be fair if Sony and Branca don't pay anything even if they went ahead to release these abominations as Michael's songs even though McClain warned them it wasn't Michael singing. But I wouldn't feel sorry for Cascio and Porté if they're are the most screwed ones Edward Cascio betrayed Michael in the lowest way.

Just take them off the album already, how they can continue selling this BS when they have admitted they are fake is beyond me.

Just take them off the album already, how they can continue selling this BS when they have admitted they are fake is beyond me. To be fair, they are admitting it for legal argument's sake. So they aren't admitting it saying "yeah, we now know and admit it's fake". It's more like "yeah, maybe it's fake, but even if they are... [insert legal argument]". Apparently their legal defense is not to challenge the claim it's fake, but that even if it is they should not be held accountable. But I agree, even if it's just "maybe it's fake" it is enough reason to remove it from MJ's catalog.

May I recommend a certain 2000 page thread on MJJC for some light reading?
